Terms & Conditions

Last updated: 28 September 2026

These Terms apply to ongoing digital support and related services provided by Up Foundry (“we”, “us”, “our”), and to promotions on this website. By ordering a service, applying for an offer, or entering a promotion, you (“the Client”) agree to these Terms.

1. The Service

We provide ongoing creative and digital support. That can include websites, sales and marketing materials, automation, connected systems, brand and creative work, internal tools, customer experience and other practical digital improvements.

The scope, priorities and time available are agreed with you. We help identify what should change, then design, build, automate or otherwise carry out the work we agree to do.

The service is not full outsourced IT or network administration, specialist legal, financial or regulatory advice, a large-scale engineering team, or unlimited work on demand. We do not take on work that needs specialist expertise we do not have.

2. Orders & Payment

After we receive an enquiry or order, we may ask for clarification and will confirm the scope, price and how the work will run before you are committed.

Paid support is billed as agreed before work starts. There are no hidden fees beyond what we have agreed with you. You may cancel a monthly service at any time. Fees already paid are refundable only where these Terms or the law say so.

Submitting a form on this website does not commit you to purchase or result in a charge.

3. Delivery

Work is carried out within the time and priorities we agree with you.

That depends on receiving the information, access and responses we reasonably need. Delays caused by missing information, access or responses may change what can be done in the agreed time.

4. Your Responsibilities

You are responsible for providing accurate information and any access reasonably required to carry out the work.

You must have the authority to ask us to work on the business, website or materials you submit.

5. Recommendations & Results

Recommendations and the work we do are based on professional judgement and the information available at the time.

Business results can be affected by many factors outside our control. We cannot guarantee specific increases in conversions, enquiries, sales, traffic, search rankings, savings or other commercial results.

You remain responsible for decisions about your business, including whether to act on a recommendation.

6. Additional Work

Work outside the agreed scope, or services we do not offer, can be discussed separately.

Any additional work will be subject to the scope, price and terms agreed for that work.

7. 100% refund guarantee

If you’re not satisfied in your first full week of paid ongoing digital support, you may request a full refund of the fees paid for that first period.

The guarantee applies to the ongoing digital support you have paid us for. It does not cover third-party costs, or work that was separately commissioned outside that service.

Refunds will be returned to the original payment method.

Nothing in these Terms affects any statutory rights you may have.

8. Free digital support offer

We may offer up to 8 hours of digital support at no charge (“the free hours offer”). The offer is a chance to try the service. It is not cash, credit, or a discount you can spend elsewhere.

Applying does not mean you are guaranteed to qualify for this offer.

We reserve the right to decline the offer to anyone, for any reason, at any time. We decide whether an applicant qualifies, and we may ask for more information before we decide. We do not have to give a reason.

We reserve the right to cancel the offer after it has been granted, without warning or compensation. That includes stopping hours that have not yet been used.

We reserve the right to change or remove the offer entirely, without warning or compensation. That includes changing who can apply, how many hours are included, what work is covered, or withdrawing the offer from the website.

9. Prize draw

We may run a promotion to win £9,000 worth of ongoing digital support. Where the promotion you enter shows a different prize, including $4,500 worth of ongoing digital support, that displayed prize applies instead. The promotion is described as: “Win £9,000 worth of digital support. Enter for your chance to win £9,000 worth of ongoing digital support.”

The prize is ongoing digital support to the advertised value. It is not cash, and it cannot be exchanged, transferred or sold. The support is provided on the same basis as our normal service, including the limits in these Terms.

The promotion runs for the period we advertise. If no closing date is shown, we may close entries at any time.

10. Liability

Nothing in these Terms excludes liability that cannot legally be excluded.

To the extent permitted by law, we are not responsible for indirect or consequential losses, loss of profits, revenue, business or anticipated savings resulting from the service, its recommendations or their implementation.

Our total liability relating to a paid service will not exceed the amount you paid us for that service. Where you have not paid us, our total liability will not exceed £100.

9. Privacy

Personal information is handled in accordance with our Privacy Policy.

10. Website Use

Content on this website is provided for general information and may be updated from time to time.

Website content may not be copied or reproduced without permission.

11. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the jurisdiction of the courts of England and Wales.

12. Contact

If you have any questions about these Terms, please contact Up Foundry through the website or by replying to an official Up Foundry email.
